Terms of Service

§ 1 Scope and Operator (1) These Terms of Service apply to the use of the online platform Ampario (www.ampario.de), operated by Elektronikhandel Michael Gräf, Breitscheidstraße 84, 70176 Stuttgart, Germany (hereinafter "Operator"). (2) Ampario is an online marketplace that enables users to buy and sell electronics (defective, refurbished, spare parts) and to offer and book repair services. (3) The Operator does not become a party to contracts concluded between buyers and sellers. Purchase contracts are concluded exclusively between the respective seller and buyer. § 2 Registration and User Account (1) Active use of the platform (creating listings, purchasing, sending messages) requires registration. Browsing listings is possible without registration. (2) A valid email address must be provided during registration. The email address must be verified by clicking a confirmation link. (3) Users may register as private individuals or commercial users. Commercial users are required to provide truthful information regarding company name, business address, and VAT ID. (4) Each user may only have one account. Login credentials must be kept confidential. § 3 Listings (1) Users may create listings in the categories: Items (defective, refurbished, spare parts), Repair Services, and Wanted/Purchase Requests. (2) Listings must contain truthful information. In particular, defects and the actual condition of items must be honestly described. (3) Only items and services whose sale or provision is legally permitted may be listed. Prohibited items include stolen goods, counterfeit products, and items that violate export restrictions. (4) The Operator reserves the right to remove listings without stating reasons. § 4 Purchase Agreement and Payment Processing (1) By clicking "Buy Now" and completing the payment process, a purchase agreement is concluded between the buyer and seller. (2) Payment processing is handled by the payment service provider Stripe. The purchase price is initially collected by Stripe and held in escrow. (3) Payout to the seller occurs after the buyer confirms receipt of goods or after the automatic release period of 14 days after shipment, provided no dispute has been opened. (4) The Operator charges a platform fee of 5% of the purchase price for the use of payment processing. This is automatically deducted from the sales proceeds. § 5 Shipping and Delivery (1) The seller is obligated to ship the item within 5 business days of receiving payment and to provide a valid tracking number. (2) The seller bears the shipping risk until delivery to the buyer. (3) For pickup, the buyer and seller arrange the handover independently. § 6 Cancellation and Refund (1) The buyer may cancel an order before shipment. For orders already paid, a full refund will be issued. (2) The seller may cancel a paid order before shipment. In this case, the purchase price is fully refunded to the buyer. (3) A statutory right of withdrawal does not exist for contracts between private individuals. For commercial sellers, statutory withdrawal regulations apply. § 7 Dispute Resolution (1) In case of problems with an order (e.g., item not received, significant deviation from description), the buyer may open a dispute within the release period. (2) The Operator reviews the dispute and makes a decision based on available information. Possible outcomes include: full refund to the buyer, payout to the seller, or closure of the case. (3) The Operator's decision in a dispute is binding regarding the release of payment but does not affect the parties' statutory rights. § 8 Reviews (1) Buyers and sellers may rate each other after completion of a transaction. (2) Reviews must be truthful and objective. Insulting, discriminatory, or false reviews are prohibited. § 9 Liability (1) The Operator merely provides the technical platform and is not a party to contracts concluded between users. (2) The Operator is not liable for the accuracy of listings, the quality of items, or the provision of services by users. (3) The Operator's liability for damages is limited to intent and gross negligence, to the extent permitted by law. (4) The Operator does not guarantee uninterrupted availability of the platform. § 10 Data Protection The collection and processing of personal data is carried out in accordance with our Privacy Policy, available at www.ampario.de/datenschutz. § 11 Suspension and Termination (1) The Operator may temporarily suspend or permanently delete user accounts in case of violations of these Terms of Service. (2) Users may delete their account at any time, provided there are no pending transactions. § 12 Changes to Terms of Service (1) The Operator reserves the right to change these Terms of Service. Changes will be communicated to users by email. (2) Continued use of the platform after the changes take effect constitutes acceptance. § 13 Final Provisions (1) The law of the Federal Republic of Germany applies. (2) Should individual provisions of these Terms of Service be invalid, the validity of the remaining provisions shall remain unaffected.
